PERKAWINAN SIRI DAN AKIBAT HUKUMNYA DALAM HUKUM PERDATA ISLAM DI INDONESIA

Marriage is an inner bond between a man and a woman as husband and wife. While what is meant by inner bonding is a relationship that cannot be seen or seen, but inner bonding is an important bond so that the bond is stronger. Legitimate marriages are marriages that are carried out according to their respective religions and beliefs according to Article 2 paragraph (1) of the Marriage Law. However, some academics and legal practitioners are of the opinion that whether a marriage is according to positive law in Indonesia is also required by whether or not the registration is recorded in the KUA (for Muslims) or the Civil Registry Office (for non-Muslims). Sirri marriage is a marriage conducted by a couple without any notice (recorded) at the Office of Religious Affairs (KUA). Meanwhile, in the sense of society, Sirri marriage is often referred to as "marriage under the hand". Sirri marriage / marriage under the hand brings a negative impact, which has no legal force, its existence is not recognized according to the Law because the implementation of Sirri marriage is contrary to State norms and methods namely Law No. 1 of 1974 concerning Marriage.
